  1. Community Website Terms and Conditions

Infoblox Inc. is pleased to provide the Community Website (the "Site"), and associated content for fostering interest and custom application development around Infoblox products. To support this environment, Infoblox provides the Site under the following terms and conditions. Please read these terms and conditions carefully before accessing the Site, or any software and other content available for download on the Site (collectively, the "Content").

BY USING THE SITE, REGISTERING AS A USER, CONTRIBUTING ANY CONTENT OR DOWNLOADING ANY CONTENT, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. This is a legal agreement between you and Infoblox. "You" refers to the person using the Site. If the Site is being used on behalf of an entity by a representative using the Site or Content on behalf of such entity, then "you" also refers to such entity. You must be at least 18 years of age to use the Site. These Terms and Conditions apply to all use of the Site and Content available on the Site. Infoblox and its affiliates and suppliers make the Site and Content available to you only under these Terms and Conditions. You are encouraged to print a copy of these Terms and Conditions for your records.

Infoblox reserves the right to modify or terminate the Site, or to terminate your access to the Site, at any time and without notice. In addition, Infoblox may change these Terms and Conditions at any time. If these Terms and Conditions are changed, Infoblox will notify you and may require that you to consent to such changes before continuing to use the Site.

Access to certain areas or services available through the Site may require you to consent to additional or different terms and conditions of use. In such cases, Infoblox will require you to opt in or otherwise affirmatively consent to any such additional terms and conditions.

  1. Community Forum; License to Contributions

Infoblox provides the Site as a forum for participants to exchange ideas and Content. By contributing any software or other content to the Site, you agree that such software and other content are provided by you under the terms and conditions of the BSD License. Infoblox and all Site participants shall be free to view, copy and use the software and other content you submit without payment of any fees in accordance with the terms of the BSD License. In consideration of this license, you agree that any copy of Content which you make shall retain all copyright and other proprietary notices in the same form and manner as on the original, and shall otherwise comply with the requirements of the BSD License. No compensation will be paid with respect to the use of your submissions. Infoblox is under no obligation to post or use any submission you may provide and may remove any submission at any time in Infoblox's sole discretion.

By posting, uploading, inputting, providing or submitting any software or other content to the Site, you warrant and represent that you own or otherwise control all of the rights to the submission including, without limitation, all the rights necessary for you to provide, post, upload, input, publish or submit the submission under the terms of the BSD License without infringing or violating the rights or any other person or entity.

  1. No Support for Content

Content that you create or download from the Site is not supported or maintained by Infoblox. If you separately purchase Infoblox standard product support and maintenance services, such services do not include support for use or integration of Content with Infoblox products. Infoblox has no obligation to provide fixes, patches or releases to correct errors in any Content, or to support or maintain compatibility of Content with any Infoblox products, regardless of whether you separately purchase Infoblox product support and maintenance services.

  1. Use of the Site and Prohibited Use

The Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, blogs, calendars, and/or other message or communication facilities designed to enable you to communicate with another user or with a group. You agree to use the communication services available through the Site only to post, send and receive messages and material that are proper and related to the purpose of the Site. As a condition of your use of the Site, you warrant to Infoblox that you will not use the Site for any purpose that is unlawful or prohibited by these Terms and Conditions or any notices from Infoblox. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site. By way of example, and not as a limitation, you agree that in connection with your use of the Site, you will not:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of other bloxHub Community members, through the Site or otherwise.
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto and have received all necessary consents.
  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such the Site specifically allows such messages.
  • Conduct or forward surveys, contests, pyramid schemes or chain letters.
  • Download any file posted by another user that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using the Site.
  • Violate any code of conduct or other guidelines which may be applicable for any particular communication service on the Site.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  • Violate any applicable laws or regulations.

Infoblox has no obligation or responsibility to monitor the communications between Site users. However, Infoblox reserves the right to review materials posted on the Site and to remove or refuse to post any materials in its sole discretion. Infoblox reserves the right to terminate your access to part or all of the Site and/or communication services at any time without notice for any or no reason.

  1. Trademarks and Copyright Ownership

The trademarks, logos and service marks ("Marks") displayed on this Site are the property of Infoblox or other third parties. Users are not permitted to use these Marks without the prior written consent of Infoblox or such third party which may own the Mark. "Infoblox" is a registered trademark of Infoblox Inc.

The Site also copyrighted material of Infoblox. Except for the Content specifically made available for your download and use under the BSD License, no other use of the copyrighted material on the Site is authorized. Except as specified above, nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent, trademark or copyright of Infoblox or any of its licensors. No portion of the Site may be reproduced in any form, or by any means, without prior written permission from Infoblox.

  1. Compliance with Applicable Laws; Export Control Laws

User access to this Site is governed by all applicable federal, state and local laws. All information available on the Site is subject to U.S. export control laws and may also be subject to the laws of the country where you reside.

All Infoblox products and publications are commercial in nature. Use duplication, or disclosure by the United States Government is subject to the restrictions set forth in DFARS 252.227-7015 and FAR 52.227-19.

Although Infoblox has attempted to provide accurate information on the Site, Infoblox assumes no responsibility for the completeness, timeliness or accuracy of the information. Infoblox may change the programs or products mentioned at any time without notice. The formation, construction and interpretation of these Terms and Conditions will be controlled by the laws of the State of California as if made between California residents entered into and to be performed within California, and giving no effect to its choice of law provisions. The U.N. Convention of Contracts for the International Sale of Goods is expressly excluded from any interpretation of these Terms. The Uniform Computer Transaction Act as adopted in some States in the United States of America will not apply. Any dispute relating to these Terms and Conditions will be subject to the exclusive jurisdiction of the state and federal courts in Santa Clara County, California, U.S.A., and the parties agree to submit to the personal and exclusive jurisdiction and venue of these courts. The Site is created, controlled and operated by Infoblox in the State of California, USA.
